Terms & Conditions

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility
   This Campaign is open only to those who sign up at the website and who are 18 years and older as of the date of entry. If you have won a giveaway or taken advantage of another Fairytale Photography Studio offer, special, or promotion within the past 24 months, you are not eligible to win. The Campaign is only open to legal residents of the United States and is void where prohibited by law. Employees of Fairytale Photography Studio, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, and immediate family members and those living in the same household are not eligible. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

2. Agreement to Rules
   By participating, you agree to be fully and unconditionally bound by these Rules and you represent and warrant that you meet eligibility requirements. You also agree to accept the decisions of Fairytale Photography Studio as final and binding regarding this Campaign.

3. Campaign Period
   Entries will be accepted online. All online entries must be received by the competition closure date stated in the form.

4. How to Enter
   Enter by submitting the online form on the website. Your entry must meet all stated requirements to be eligible. Incomplete entries or entries that do not follow the rules may be disqualified at the sole discretion of Fairytale Photography Studio. You may enter once unless otherwise stated. Do not use multiple emails, identities, or devices to circumvent rules. Fraudulent methods or attempts to circumvent rules may result in disqualification.

5. Prizes
   The Grand Prize Winner will receive a Session and 14" Portrait. Actual value may differ at time of award. Prize specifics are at the sole discretion of Fairytale Photography Studio. No cash or other substitution is permitted except at our discretion. Prizes are non transferable. All taxes and expenses related to the prize are the sole responsibility of the Winner. Acceptance of prize grants Fairytale Photography Studio permission to use Winner’s name, likeness, and entry for advertising and trade without further compensation, unless prohibited by law. Any prizes provided in addition to studio-supplied prizes may be subject to sharing your email and phone number for promotional use only.

6. Odds
   Odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification
   Winner will be selected by random drawing under the supervision of Fairytale Photography Studio. Winner will be notified by phone and email within five days of selection. We are not responsible for a Winner’s failure to receive notices due to spam filters, junk email, security settings, or incorrect contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within ten days from notification, or fails to timely return required documents, the prize may be forfeited and an alternate Winner selected. Receipt of the prize is conditioned on compliance with all applicable laws and regulations. Any rule violation may result in disqualification at our sole discretion.

8. Rights Granted by You
   By entering content, you grant Fairytale Photography Studio, its agents, licensees, successors, and assigns the right to print, publish, broadcast, distribute, and use in any media now known or later developed, in perpetuity and worldwide, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without further compensation, notice, review, or consent. You represent and warrant that your entry is original and does not violate third-party rights. You agree to defend and indemnify Fairytale Photography Studio against claims arising from any alleged infringement.

9. Terms and Conditions
   Fairytale Photography Studio reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Campaign should virus, bug, unauthorized human intervention, fraud, or other cause beyond our control affect administration, security, fairness, or proper conduct. In such case, we may select a Winner from eligible entries received before and after the action. We may disqualify any individual who tampers with the entry process or operation of the Campaign or website or who violates these Terms and Conditions. We may void votes or entries for reasons including multiple entries from the same user from different IP addresses, multiple entries from the same computer in excess of allowed limits, or the use of bots, macros, scripts, or other technical means. Any attempt to damage any website or undermine legitimate operation may violate criminal and civil laws. We reserve the right to seek damages to the fullest extent permitted by law. 10. Limitation of Liability
    By entering, you agree to release and hold harmless Fairytale Photography Studio and its subsidiaries, affiliates, agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: your participation and acceptance, possession, use, or misuse of any prize; technical failures of any kind; unavailability or inaccessibility of transmissions, phone, or internet service; unauthorized human intervention; or errors in administration or processing.

11. Disputes
    This Campaign is governed by the laws of the United States and Texas, without respect to conflict of law doctrines. As a condition of participating, you agree that all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Campaign shall be resolved individually, without resort to any class action, exclusively before a court located in Texas having jurisdiction. In any such dispute, you will not be permitted to obtain awards for punitive, incidental, or consequential damages, including attorney’s fees, other than your actual out-of-pocket expenses. You waive all rights to have damages multiplied or increased.

12. Privacy Policy
    Information submitted with an entry is subject to our Privacy Policy at fairytalephotographystudio.com/privacy-policy and the Privacy Policy posted on our website.

13. Winners List
    To obtain the Winner’s name or a copy of these Official Rules, mail a request with a stamped, self-addressed envelope to: Fairytale Photography Studio, 1717 St James Pl #655, Houston, TX 77056.

14. Sponsor
    The Sponsor is Fairytale Photography Studio, 1717 St James Pl #655, Houston, TX 77056. If you use Meta to enter, note: the Campaign hosted by Fairytale Photography Studio is in no way sponsored, endorsed, administered by, or associated with Meta.

15. Major Contests Promotional Duration and Prize Drawings
    Our Major Prize Campaign is part of a 12-month promotional giveaway run on Meta and other social and online platforms by Fairytale Photography Studio. Two major prize winners will be selected in a final drawing at the end of the 12-month promotional period. All participants remain eligible for the major prize drawing. Major prize winners will be contacted directly and publicly announced on Fairytale Photography Studio’s official social media pages. To inquire about the exact start date of a promotional period, contact Fairytale Photography Studio.

Studio Terms Applied To Competitions, Gift Certificates, Appointments, and Services

1. Competitions
   Entry is open only to persons 18 years and over who are residents of Texas and who have not won a competition, prize, or promotional item with Fairytale Photography Studio in the last 24 months. To enter, completed original entry coupons must be received at the studio by the promotion end date. Late entries will not be accepted. Entry coupons not properly completed will be rejected. Contestants may enter as many times as they like, provided entries are received before the closing date. Prize winners will be notified by mail, email, or phone. The major prize winner will be the first valid entry drawn on the day of the draw. First Prizes are valid for 1 month from the draw date. Consolation Prizes expire 3 months from the date printed on the Gift Certificate. Prizes are for studio portraiture only. Prizes are non transferable, not exchangeable, and not redeemable for cash. Prizes cannot be used with any other offer or promotion. The judges’ decision is final and no correspondence will be entered into.
   Note: Section 1 governs Campaign eligibility. Section 16 governs studio-run in-Texas competitions. Follow the eligibility stated in the specific promotion materials.

2. Gift Certificates
   You must redeem certificates before the expiration date, provided you have not redeemed a Competition Prize or Gift Certificate with Fairytale Photography Studio in the last 24 months, measured from the previous sitting date. Prizes are for studio portraiture only. One certificate per household. Certificates cannot be combined.

3. Appointment Holding Deposits
   A holding fee or deposit is required to secure and hold your appointments. We refund the deposit at your completed appointment if you complete both your photo shoot and viewing appointment at the scheduled time and date. These appointments are scheduled on the same day. Failure to attend or complete your scheduled appointment cancels any prize and forfeits the holding fee. At your discretion, you may apply the holding fee to an order if you choose to make a purchase. You are not obligated to purchase. If you are 15 minutes late or more, we may not be able to see you and your deposit will be forfeited.

4. Transferable
   Prizes and Gift Certificates are non transferable. They are not exchangeable or redeemable in whole or in part for cash. Certificates cannot be used with any other offer, prize, or promotion. Only one Gift Certificate or Prize Certificate can be used at a time. You cannot use any certificate to purchase products from other sessions or toward framing.

5. Meta Competition
   By entering a Meta competition, you acknowledge that the promotion is in no way sponsored, endorsed, administered by, or associated with Meta.

6. Artistic Control
   Fairytale Photography Studio reserves artistic control over the design and content of each session. We may decline to create certain types or styles of photography. We may refuse to produce images at some sizes or combinations of sizes if we believe those images could be detrimental to our reputation. Discuss your requirements with the studio before the session.

7. Refusal of Service
   We reserve the right to refuse service if, in our opinion, providing service is likely to cause or has caused disruption to staff or the normal operation of business.

8. Appointment Reschedule Policy
   Gift Certificates and Prize Certificates entitle the holder to a single appointment only. Once scheduled, an appointment cannot be rescheduled and the certificate is deemed used in full at that original time and date. Note: in exceptional circumstances, management may, at its sole discretion, reschedule an appointment and carry forward the certificate and holding fee.

9. No Show Policy
   Non attendance without notice results in forfeiture of the holding or deposit fee. The certificate is deemed used in full.

10. Extended Family Policy
    Extended families are groups larger than three children. Different prices apply. Contact the studio for a current quote. Extended family bookings are taken at the photographer’s discretion and require an in-studio consultation to book. Prize certificates are not available for extended family sessions.

11. Copyright
    Unrestricted copyright to all images created during the photo shoot that forms part of the Gift Certificate or Prize Certificate belongs solely to Fairytale Photography Studio.

12. Refunds
    We do not provide a refund or replacement if you change your mind. Fairytale Photography Studio stands behind our work. If you are not fully satisfied with your portrait, refer to the policy on your signed agreement or order form.

13. SMS Notifications and Consent
    By submitting your information, you agree to receive SMS notifications, reminders, and occasional marketing messages from Fairytale Photography Studio.

    Messages may include session confirmations, reminders, preparation details, or promotional content.

14. Payment Plan Options
    Fairytale Photography Studio offers flexible low or no interest payment plan options to help you pay for artwork over time. All plans must be authorized by signature on the invoice at the time of sale. Installments must be direct debited from a credit or debit card according to the agreed schedule. Physical artwork will not proceed to finishing until the invoice total has been paid in full. You may make additional payments or pay off early at any time.

15. Defaulting on the Payment Plan
    If a scheduled payment is declined, we will attempt to reprocess the payment on the next business day. If the second attempt is unsuccessful and 14 days pass from the failed payment date, we will issue a notice to rectify the overdue amount. If your account remains unpaid 30 days after the original notice, we may initiate a debt collection process. Any associated fees will be your responsibility. A dishonor fee of $25 will be applied for each unsuccessful payment attempt. If your credit card number or expiration date changes for any card used for recurring payments, you must notify the studio as soon as possible to avoid interruption.
